Welcome to Dexter Archive! These Terms of Service ("Terms") govern your use of the Dexter Archive website ("Service"), which is operated by a two-person team dedicated to preserving and exploring the Dexter universe. By accessing or using our Service, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you may not use our Service.

1. About Dexter Archive

Dexter Archive is a fan-driven, non-commercial archiving project aimed at becoming "The Hitchhiker's Guide to the Dexter Universe." Our primary purpose is to gather, archive, and analyze text data and images related to the Dexter series, primarily from sources like DexterDaily and certain subreddits. We are in early development, and as such, the Service may have rough edges, missing features, and incomplete information. We are not a replacement for, nor do we compete with, existing resources like IMDb, Wikipedia, Fandom, or Dexter Daily; rather, we aim to be a complementary resource offering unique insights through data analysis.

2. Use of the Service

Access: You are granted a limited, non-exclusive, non-transferable, and revocable license to access and use the Service for your personal, non-commercial use, subject to these Terms.

No Registration (Currently): As of now, user registration is not available.

Accuracy of Information: We strive for accuracy in the information presented but, given the early development stage and the nature of automated data collection, we cannot guarantee that all information is always complete, accurate, or up-to-date. Data is subject to review and potential changes.

3. User-Provided Content (File Uploads)

Our Service currently allows users to upload files (e.g., images) to contribute to our archive or for reference image searches. When you upload files:

• Confirmation Required: You will be required to check boxes confirming that you own the rights to the uploaded files and that you have read and accepted our Privacy Policy.
• Storage and Review: All uploaded files will be saved on our server. Files and any associated data from forms will be reviewed by our team. We reserve the right to review, modify, or decline to publish any submitted content at our sole discretion.
• Public Availability: Uploaded files will not be publicly available until they have been verified and approved by our team.
• Data Use: The primary purpose of accepting file uploads is to enrich our Dexter Universe archive. By uploading, you grant Dexter Archive a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, and sublicensable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, and display such content in connection with the Service and for the promotion and archiving efforts of Dexter Archive.

By uploading any content, you represent and warrant that:

• Ownership & Rights: You own or have the necessary licenses, rights, consents, and permissions to use and authorize Dexter Archive to use all patent, trademark, trade secret, copyright, or other proprietary rights in and to any and all User Content to enable inclusion and use of the User Content in the manner contemplated by the Service and these Terms.
• No Infringement: Your uploaded content does not infringe upon the rights of any third party, including copyright, trademark, privacy, publicity, or other personal or proprietary rights.
• Legality: Your content is not illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable.

Dexter Archive does not endorse any content submitted by users or any opinion, recommendation, or advice expressed therein, and we expressly disclaim any and all liability in connection with User Content.

4. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of Dexter Archive and its licensors. Our content is protected by copyright, trademark, and other laws of both Ukraine and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Dexter Archive.

5. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. Dexter Archive makes no representations or warranties of any kind, express or implied, as to the operation of their Service, or the information, content, or materials included thereon. You expressly agree that your use of the Service is at your sole risk.

To the full extent permissible by applicable law, Dexter Archive disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose.

6. Limitation of Liability

In no event shall Dexter Archive, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

7. Governing Law

These Terms shall be governed and construed in accordance with the laws of Ukraine, without regard to its conflict of law provisions.

8. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
